The Applicant in the case also requested the District & Sessions Judge to take the record/case file under its custody as Farrukh Fareed Baloch earlier too allowed the changes/tampering of evidence in the court file by the commission in support of the Defendant/cheque defaulter and had given the entire original case file to the commission who had kept it in her private chamber for days which is against law.
I will fix you, I know how to fix people, …Farrukh Fareed Baloch the Additional Sessions Judge Islamabad in open court today threatened the Plaintiff in aid of a cheque defaulter property dealer during open court proceedings today.
An Applicant today moved application for transfer of case and strict legal/administrative action against the Additional District & Sessions Judge Islamabad Mr. Farrukh Fareed Baloch, the Defendant a notorious property dealer/ frontman of benami properties and cheque defaulter and the Defendant’s counsel juniors and the local commission a lady allegedly favorite of the judge appointed as commission for recording of evidences.
The application filed by the aggrieved applicant/plaintiff states:

That the subject case was fixed for cross examination on 5-10-2022 and the Plaintiff and his counsel from Rawalpindi were present and the matter was pending for entire day and eventually because of non-readiness of Defendant’s counsel along with commission who was appointed by the court to record evidence and the cross examination the matter was adjourned for today i.e. 8-10-2022. It is worth mentioning here that the attitude of the commission was pathetic and biased towards the Plaintiff throughout the proceedings which was so many times brought to the notice of the Honourable Court which gave no heed to the Plaintiff/Applicant’s requests.

That today the Plaintiff counsel, plaintiff and the witnesses were present sharp 10 am but intentionally in connivance with Defendant party the commission came late at 11 am but started passing biased comments on the Plaintiff and twice the juniors of the Defendant counsel came threatening the Plaintiff in court premises for dire consequences.

That shockingly today during the proceedings, the commission intentionally misbehaved with the Plaintiff in the open court which obnoxious conduct was again brought before the notice of Honorable court today but surprisingly the Honorable court inspite of asking the commission deliberately snubbed the Plaintiff in open court and misbehaved by using unethical language. Hence the Plaintiff has no other effective remedy except to file this application.
The application is fixed for hearing by the Honorable District & Sessions Judge Islamabad on 11th October, 2022 wherein notices to the parties are ordered and file is summoned along report on the application of Applicant/Plaintiff.
